Terms of Service

These Terms of Service (the "Agreement") are an agreement between Giga-Rapid.com ("GigaRapid" or "us" or "our") and you ("User" or "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the products and services made available by GigaRapid and of the Giga-Rapid.com website (collectively, the "Services"). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.

Use of the Services is also governed by the following policies, which are incorporated by reference. By using the Services, you also agree to the terms of the following policies.

The security of your account with GigaRapid rests upon you as a customer. You must keep your password unique and must not share it with anybody else. If you notice anything wrong with your account /servers, immediately contact our support team and we’ll take necessary steps.
You as a customer are solely responsible for any actions taken by your account and for the content stored on our servers by you. You agree to bear any charges which GigaRapid may have to incur to make good the losses caused by your actions.

The amount you pay for your service will not increase from the date of purchase in the current billing cycle, however prices may be increased from next billing cycle. GigaRapid reserves the right to alter prices,storage quantities, network rates, network volumes, computational capabilities, features and functionality of all Services at its sole discretion.

Any Services sold by GigaRapid to Customer will be delivered to the email address as specified in your GigaRapid Account.

You can also read all emails we have sent to you, in your member area.

Since we don't offer any physical products, we don't need to ship/courier any items to client's address.

We offer Hosting Services and its login details are sent on client's email which may be deemed as proof of activation of client's services.

Date of Activation of service will be the initial date of start of validity of services.

GigaRapid retains the right remove or retain the content stored on GigaRapid's servers in the event of non-payment for the Services.

The Customer agrees and understands the refund policy provided by GigaRapid.To prevent abuse, GigaRapid reserves the right to refuse future services to any Customer seeking multiple refunds.

The Customer understands and agrees that interruptions of any Services may occur at any time and without prior notification, and may continue for any duration. The Customer agrees that under no circumstances will GigaRapid be held liable for any financial or other damages due to such interruptions. In no event shall GigaRapid be held liable to the Customer for any damages, including but not limited to refunds, fees, loss of profits, loss of income, or cost of replacement services. The failure or interruption shall not be considered a default under these Terms.

The Customer is responsible for independent backup of data stored on GigaRapid's servers; unless the Customer has arranged for Services which include backup services in which case data backup will be performed under the terms of the specific data backup plan chosen by the Customer. GigaRapid shall never be held liable for failure to recover data in the event of any sort of failure, and shall never be held accountable financially or otherwise for loss of data.

GigaRapid and Customer agree that GigaRapid is solely acting as a common carrier in its capacity of providing services. Customer agrees that they are the publisher of any material or information and responsible for it adhering to the Terms.The content distributed by Customer is in no way reflective of GigaRapid, GigaRapid does not filter or inspect the content distributed by Customer using Services (as outlined in our Privacy Policy). All material stored or distributed by the Customer using Services is considered publicly accessible. GigaRapid distribution of content provided by Customer does not express or imply approval of material by GigaRapid, nor does it confirm that the material is in compliance with the Terms.

Acceptable Use Policy ("AUP") governs your use of the Services and is incorporated by reference into GigaRapid's Terms of Service. Unless otherwise stated, defined terms in this AUP have the meanings provided in the Terms of Service. The Services provided by GigaRapid may only be used for lawful purposes. You agree to comply with all applicable laws, rules and regulations in connection with your use of the Services. GigaRapid reserves the right to refuse service to anyone. Any material that in our judgment violates this AUP in any manner may be removed from our servers (or otherwise disabled), with or without notice. Failure to respond to an email from our abuse department within the specified time period in our email to you may result in the suspension or termination of the Services.


Acceptable Use Policy - GigaCloudTransfer
The Customer is fully and solely responsible for his content stored on, downloaded to, or distributed from their services made available to him/her by GigaRapid.The Customer certifies that they have legal rights to distribute and store everything stored on their Services.All services provided by GigaRapid may be used for lawful purposes only.
Content uploaded, stored, emailed or transmitted by clients on our servers must not contain any files which violate local and international laws and treaties, Which includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and unsolicited email (Spam) and invasion of privacy.
Under any circumstances you are not allowed to use this service for:
Anything that can result in Spamhaus listing, DDoS originations, Spam email , Netscan/Hack programs and archives, Malicious Scripts (ex: originate DDoS attacks or hack attempts), Botnet/Doorway/Carding, FileHosting/FileSharing If any of this happens it will result in an immediate service termination
Customers may not store child pornography or kidnapping material, Customers who store and / or upload child pornography will have their servers suspended immediately without any warnings / notices. We will also hand over all your personal details to federal authorities for legal recourse. Any activity which creates hatred against minors or which hurts the sentiments of minors is banned.
No CDN. Customer shall not be entitled to use the Service for the purpose of operating 'Content Delivery Network' except with GigaRapid’s prior written consent, which consent may be granted or withheld at GigaRapid’s sole discretion.
Customers may not send Distributed Denial of Service (DDoS) or Denial of Service attacks to others using our servers. This will lead to immediate termination without any refund settlement.
Fair Use Policy: 
i. The service is provided to end-user Customers for normal, fair, and reasonable use. Bandwidth usage is to be reasonably consistent throughout every month, without irregular bandwidth usage patterns, either individually or as part of a group of Customer servers. 
ii. Customers may not use more than fifty-five percent (50%) of our system resources for longer than one hour at a time. Activities that could cause this excessive use, include but are not limited to: Archiving, Downloading Files,Uploading etc
In the event GigaRapid, in its sole discretion, determines that the Customer is not using the Service  according to this Fair Use Policy, GigaRapid will be entitled to:  (a) impose limits on the speed of the data the Customer may transmit and/or receive on any or all Customer servers with this Service. (b) re-price any or all Customer servers with this Service to the regular bandwidth rate;  (c) suspend or terminate the Service to any or all servers provided to the Customer, at GigaRapid’s sole option.


Acceptable Use Policy - GigaSeedBox
The Customer is fully and solely responsible for his content stored on, downloaded to, or distributed from their services made available to him/her by GigaRapid.The Customer certifies that they have legal rights to distribute and store everything stored on their Services.All services provided by GigaRapid may be used for lawful purposes only.

ii. Customers may not use more than seventy-five percent (70%) of our system resources for longer than one hour     at a time. Activities that could cause this excessive use, include but are not limited to: Archiving, Downloading Files,Uploading etc
In the event GigaRapid, in its sole discretion, determines that the Customer is not using the Service  according to this Fair Use Policy, GigaRapid will be entitled to:  (a) impose limits on the speed of the data the Customer may transmit and/or receive on any or all Customer servers with this Service. (b) re-price any or all Customer servers with this Service to the regular bandwidth rate;  (c) suspend or terminate the Service to any or all servers provided to the Customer, at GigaRapid’s sole option.

Copyright holders

If you believe one of our customers is distributing your content without appropriate rights or license, you may contact our abuse department via ticket.

Illegal content

If you believe one of our customers is distributing illegal material. Please contact us immediately. Please provide us with the IP, ports, URLs and any other relevant information that might help us quickly resolve the matter.

Attacks on other networks

If you believe one of our customers is actively attacking your server or network we would be happy to resolve the situation. In many cases situations like this occur from a customer who has themselves been compromised by a malicious party and who is unaware that their server credentials have been compromised.To ensure a swift resolution, please describe the nature of the attack in as much detail as you are able. Provide us with all of the relevant details for the nature of the attack. This may include your server IP, our server IP and the relevant ports and UTC timestamps. Log samples, URLs and other information are also welcome to help expedite resolution.

Kindly send your abuse reports in English only to our abuse department. All Abuse reports will be handled manually as soon as possible.Please allow 4-5 business days (maximum) for review and processing.

GigaRapid shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from GigaRapid servers going off-line or being unavailable for any reason whatsoever. All damages shall be limited to the immediate termination of service.

The Subscriber shall indicate acceptance of this Agreement in the course of submitting an order to the Service Provider through the Service Provider’s electronic order form or by accessing the Service.The Service Provider shall indicate acceptance of this Agreement by sending confirmation of the order to the Subscriber by electronic mail.

GigaRapid may, at its sole discretion, without any prior notice amend / modify this agreement from time to time as it may deem fit. Modified ToS will be placed on GigaRapid website and those terms will come into force immediately for all existing and future customer(s). All previous terms would be superseded in such cases.

If the customer does not agree to any new terms – it is their responsibility to terminate the subscription. If the customer does not terminate their subscription within 15 (fifteen) days of the modification, then the continued use of the service(s) will mean that the customer has no objections to the amended terms of service.
